In short
- You own your videos, funnels and leads. We only use them to run the Service for you.
- Plans renew monthly and you can cancel anytime; limits pause features but never cost extra. See the Refund Policy.
- For your viewers’ data, you are the controller and we are your processor. You need a lawful basis and consent where required.
- Strictly prohibited: illegal or harmful content, phishing and scams, collecting passwords, card or ID numbers, spam, fake traffic, security bypasses and multi-account abuse.
- We act in proportion to the problem, and immediately for serious harm. You can appeal any decision.
This summary is for convenience. The full text below is what applies.
1. Who we are and this agreement
These Terms of Service (“Terms”) are an agreement between you and [Company legal name], [registered address, country] (“VideoSaysHi”, “we”, “us”). They cover videosayshi.com, app.videosayshi.com, funnels we host (including on custom domains), our embed code and any related services (together, the “Service”).
By creating an account, starting a subscription or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you use the Service for a company or client, you confirm you are allowed to accept these Terms on its behalf, and “you” means that organisation too.
You must be at least 18 years old. The Service is intended for business and professional use.
2. Words we use
- Workspace: the space where your projects, videos, funnels and leads live. Agency plans can have up to 3 workspaces that share the plan’s limits.
- Funnel: an interactive video experience you build and publish, with steps such as videos, choices, forms, quizzes, booking and redirects.
- Viewer: anyone who watches or interacts with one of your funnels.
- Your Content: everything you or your team upload or create in the Service: videos, images, files, text, funnel designs, forms and settings.
- Viewer Data: information your funnels collect from viewers, such as answers, contact details, uploaded files, bookings, quiz results and visit activity.
3. Your account
- Give accurate details when you sign up and keep them up to date. You must verify your email address.
- Keep your password secret and use a strong, unique one. We block passwords known to have appeared in data breaches. Tell us straight away at support@videosayshi.com if you think someone else has access to your account.
- Each login is for one person. Do not share logins; invite team members instead. You are responsible for what everyone you invite does in your workspaces, and for choosing their role (Owner, Admin, Editor or Viewer).
- You are responsible for all activity in your account, including funnels published from it.
- Our staff may access a workspace only to provide support, investigate abuse or security issues, or when required by law. Every such access requires a recorded reason and expires automatically.
4. Plans, limits and fair use
Each plan includes the limits shown on our pricing page and in Billing, for example the number of funnels, library videos, storage, monthly video plays, monthly responses, users, workspaces and monthly AI or email allowances.
- Monthly allowances reset at the start of each billing period and do not roll over. On a yearly plan they reset every month, on the day of the month you started.
- When a limit is reached, the related feature pauses (for example funnels stop playing or stop collecting new responses) until the next period or an upgrade. We never charge you extra for going over a limit.
- Each video can be up to 10 minutes and 250 MB on Starter, 30 minutes and 500 MB on Pro, and 60 minutes and 1 GB on Agency, in MP4, MOV, M4V or WebM format. We convert every upload into standard MP4 versions for playback.
- Limits are per account, not per person or per business. Opening several accounts, or trial-style accounts, to get around limits or the refund guarantee is not allowed (see Acceptable use).
- We may change plan features and limits. If a change reduces what your current plan includes, we will tell you at least 30 days before it applies to you, and you may cancel before then.
5. Billing and payments
- Subscriptions are billed monthly in advance (Starter and Pro can also be billed yearly in advance) and renew automatically until cancelled. You can cancel at any time in Settings → Subscription; the plan stays active until the end of the period you paid for.
- Payments are processed by our payment partner, shown at checkout. We do not receive or store your full card number. The payment partner’s checkout terms, shown when you pay, also apply to payments.
- Prices are shown before you pay and may exclude taxes, which are added where required.
- Upgrades start immediately and are charged at the full price of the new plan; unused days of the previous plan are not refunded or credited, as shown at checkout. Downgrades take effect at renewal. A yearly plan changes plan or billing period when the year ends.
- We may change prices with at least 30 days’ notice by email. A new price applies from your next renewal after that notice; if you do not agree, cancel before then.
- If a payment fails, we may pause upgrades and, if it still cannot be collected, end the plan.
- Refunds are covered by our Refund Policy, including the 7-day first-payment guarantee.
6. Your content
You keep ownership of Your Content and your Viewer Data. We do not claim any rights over them other than those needed to run the Service.
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, convert (for example into different video qualities and thumbnails), display, stream and deliver Your Content, only as needed to provide, secure and support the Service for you and your viewers. This licence ends when Your Content is deleted from the Service, apart from copies we must keep for legal reasons or that remain in backups for a limited time.
You confirm that you have all the rights and permissions needed for Your Content, including:
- rights to the videos, music, images, logos and text you upload;
- the consent of every identifiable person who appears in your videos, where the law requires it;
- permission to use any trademarks or brand names shown.
We do not review funnels before they are published, but we may review content when it is reported or when we see signs of abuse, and act as described in Enforcement.
7. Your viewers and their data
When your funnels collect Viewer Data, you are the controller of that data (you decide why and how it is collected) and we are your processor: we store and handle it only to run the Service for you, following your instructions and our Privacy Policy. You agree that:
- You have a lawful basis to collect each piece of information you ask for, and you tell viewers who you are and how you use their data (for example through your own privacy notice linked in your funnel).
- You get consent where the law requires it, especially for marketing emails, texts and calls (for example under GDPR, the ePrivacy rules, CAN-SPAM, CASL and TCPA), and you honour opt-outs and data requests.
- If you add your own tracking pixels or third-party tools to a funnel, you are responsible for any consent they need.
- If you send leads to an email marketing tool, you add people to mailing lists only with the permission the law requires. Our “marketing emails” consent checkbox, the email card opt-in and the email integrations’ consent settings help you do this; by default, only people who ticked the box are added.
- You collect only what you need, and you do not collect special-category or highly sensitive data (such as health, biometric or financial account data) unless the law allows it and you have the safeguards it requires.
- You use the built-in privacy tools (retention settings and find, export and erase) or ask us for help to answer viewers’ requests within the time the law allows.
If you need a signed data processing agreement, email support@videosayshi.com.
8. Acceptable use and platform abuse
To keep VideoSaysHi safe for customers and viewers, you and your team must not use the Service, or let anyone use it, for any of the following. This applies to Your Content, your funnels, your videos, what you link to and how you use our systems.
A. Illegal and harmful content
- Anything illegal, or that promotes, helps or instructs illegal activity.
- Child sexual abuse material or any sexual content involving minors. Zero tolerance: we remove it, close the account immediately and report it to the relevant authorities (such as NCMEC).
- Sexually explicit or pornographic content, or sexual services.
- Content that promotes terrorism or violent extremism, or graphic violence shown to shock.
- Hate speech, or content attacking people for protected characteristics such as race, ethnicity, religion, disability, sex, gender identity or sexual orientation.
- Harassment, bullying, threats, doxxing or sharing someone’s private information without permission.
- Content that encourages self-harm, suicide or eating disorders.
- Sale or promotion of illegal drugs, weapons, explosives, counterfeit goods or other regulated goods without the required licences.
- Content that infringes copyright, trademarks, privacy, publicity or other rights, or that is defamatory.
B. Deceptive and fraudulent funnels
- Phishing: funnels that imitate a login page, bank, government body, delivery company or other brand to obtain credentials, payment details or personal data.
- Impersonating any person, company or organisation, or suggesting a connection that does not exist.
- Scams, including fake giveaways, advance-fee fraud, pyramid or multi-level schemes, and “get rich quick”, crypto or investment offers that promise unrealistic returns.
- Fake reviews, fake testimonials, or deepfake or AI-generated video of real people used without their consent or to mislead.
- False or misleading claims about health, medical treatment, finances or results that could cause harm, or claims that break advertising law.
- Quizzes, forms or “assessments” designed to trick people into giving personal data they would not otherwise give, or hiding who is collecting it.
C. Sensitive data you must not collect
- Passwords, PINs or security answers for any service.
- Full payment card numbers, CVV codes or bank login details.
- Government ID numbers or ID document scans (such as social security numbers or passport scans), unless you are legally required to collect them and have the right safeguards.
- Health, biometric, genetic or other special-category data, unless the law allows it and you have the consent and safeguards it requires.
- Any data from children under 16 (or the local age of digital consent). Do not build funnels aimed at children.
D. Spam and unwanted messages
- Sending funnel links in unsolicited bulk email, SMS, direct messages or comments.
- Uploading or importing bought, rented or scraped contact lists, or contacting leads without the consent the law requires.
- Using booking, form or email features to send messages to people who did not ask for them.
E. Technical abuse
- Uploading malware, viruses or harmful code, or using custom HTML, links, redirects or files to deliver them.
- Trying to get around security, access controls, signed media links, rate limits or plan limits, or accessing data or accounts that are not yours.
- Probing, scanning, load testing or stress testing our systems, or anything that places an unreasonable load on them, without our written permission. Security researchers: please report issues to support@videosayshi.com and we will work with you.
- Generating fake plays, clicks, responses, leads or bookings, whether by bots, scripts or paid traffic designed to inflate numbers.
- Scraping, copying or downloading the Service, other customers’ funnels or our media in bulk, or hotlinking our video files outside our player.
- Using the Service mainly as file hosting or a video delivery network for other websites or apps.
- Reverse engineering, decompiling or disassembling the Service, except where the law allows it despite this restriction.
F. Account and plan abuse
- Creating several accounts to get around plan limits, the 7-day refund guarantee or a suspension.
- Selling, renting, reselling or sublicensing access to the Service. Agency customers and Growth or Advanced lifetime customers may build and run funnels for their own clients, but may not give them a login as a resold VideoSaysHi service.
- Using the Service to build or train a competing product.
- Opening an account with false information, or someone else’s identity or payment method.
- Filing false chargebacks or payment disputes.
9. How we enforce these rules
We act in proportion to how serious the problem is, and we try to give you a chance to fix it. Depending on the situation we may:
- Warn you and ask you to change or remove content within a set time.
- Remove or disable specific content, videos or funnels, or turn off a feature.
- Restrict the account, for example pausing publishing, uploads, integrations or email sending.
- Suspend the account while we investigate.
- Close the account and ban related accounts.
We act immediately and without notice for child sexual abuse material, phishing, malware, fraud, credible threats of violence, serious harm to viewers, legal orders, or anything that puts our systems or other customers at risk.
- We tell you what we did and why, unless the law or safety reasons prevent it.
- Payments are not refunded for accounts restricted or closed because of a breach of these Terms.
- We may keep records and evidence, and report illegal activity to law enforcement or other authorities, when the law requires or permits it.
- Appeals: if you think we made a mistake, email support@videosayshi.com with the subject “Appeal” within 30 days. A person who was not involved in the original decision reviews it, and we reply within 14 days. If we got it wrong, we restore the content or account.
10. Reporting abuse and copyright complaints
Report a funnel
If you see a VideoSaysHi funnel that breaks these rules, choose Report this funnel in the player's menu (the gear button), or email support@videosayshi.com with the subject “Abuse report”, the funnel link and what is wrong. We review reports promptly and prioritise phishing, fraud and harm to children. We do not tell the account owner who reported them.
Copyright notices
If you believe content on the Service infringes your copyright, email support@videosayshi.com with the subject “Copyright notice” and include:
- your name and contact details, and your signature (a typed name is fine);
- a description of the copyrighted work;
- the link to the funnel or content you believe infringes it;
- a statement that you believe in good faith the use is not authorised by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
We remove or disable the content and tell the account owner. The account owner may send a counter-notice with the same details, explaining why the removal was a mistake; we may then restore the content unless the complaining party tells us they have started court action. We close the accounts of repeat infringers. Knowingly false notices may make the sender liable for damages.
11. Third-party services and integrations
The Service works with other services you choose to connect, such as Calendly and Cal.com (booking), HubSpot, Mailchimp, Kit, Brevo, MailerLite, GoHighLevel, Google Sheets, Zapier and webhooks. When you connect or send data to them, their own terms and privacy policies apply, and they are responsible for their services. We are not responsible for data once it has been delivered to a destination you configured.
12. Payments in funnels
- Where available, you may connect your own account with a third-party payment processor and add a payment button to your funnels. Viewers pay your account directly; the sale is between you and the viewer.
- You are the seller. You set the price and are responsible for what you sell, for taxes, receipts, refunds, chargebacks and disputes, and for following the payment processor’s terms and the law.
- We take no fee on these payments. The payment processor’s own fees and terms apply.
- Card details are entered in the payment processor’s secure form and never reach our servers. We keep a record of each payment (amount, currency, what it was for and its status) to show it in your dashboard.
- We may hide payment buttons or disconnect payments to protect viewers, to stop misuse, or to comply with the law.
13. AI features
- AI lead briefs and AI reports are optional and only work after a workspace owner or admin switches them on.
- Before responses are sent to our AI provider, we remove names, email addresses, phone numbers, street addresses and links. The provider processes the rest only to produce your summary.
- AI Builder sends the answers you type, or the text of the document you choose (read on your device; the file itself is not uploaded), to our AI provider to draft a funnel outline. The outline and scripts are saved in your workspace. AI Builder only creates drafts: review every draft before you publish it.
- AI pictures send the description you type to our AI providers to check it against our rules and to make the picture. Pictures may not show religious figures, sexual content, real children, politicians, brand logos or words, or a real person promoting your business, and we may refuse a description for these reasons. Pictures of well-known people carry an “AI-generated image” label: do not remove or hide it. Using a real person's likeness in marketing can need their permission, and you are responsible for having it.
- AI output can be incomplete or wrong. Check it before relying on it, and do not use it as the only basis for decisions with legal or similarly significant effects on a person.
- You are responsible for how you use AI output, including anything you send to leads.
14. Our service and changes
We work hard to keep the Service fast, secure and available, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, which we try to schedule for quiet times and announce in advance when it affects you noticeably.
We improve the Service all the time and may add, change or remove features. If we remove a major paid feature you rely on, we will give reasonable notice and, if you cancel because of it, refund the unused part of your current period.
The VideoSaysHi name, logo, software, templates and designs are ours or our licensors’. You may use the templates we provide in your own funnels, but these Terms do not give you any other rights in them.
If you send us feedback or ideas, we may use them without any obligation to you.
15. Cancelling, closing an account and your data
- You can cancel your subscription at any time in Settings → Subscription. Your plan stays active until the end of the paid period.
- When a paid plan ends, published funnels stop playing and new responses are not collected. Your content and data stay saved for 90 days, so you can come back or ask us for a copy of your leads.
- After 90 days without a plan, the workspace’s content is deleted: funnels, videos, pictures and files, leads, responses, bookings and connected integrations. A workspace that never paid (for example, a free trial that ended without a payment) is kept for 30 days instead. We email the workspace owners when the countdown starts and again before the deletion, and choosing any plan before the date stops it. Your login, team and billing records are kept. Content can also be removed sooner if you ask us to delete it or under your retention settings.
- Agency extra workspaces are deleted 30 days after the Agency plan ends, with their videos and data.
- To delete your account and all its data, email support@videosayshi.com from the account’s email address. We confirm the request and complete the deletion within 30 days, apart from records we must keep by law (such as billing records).
- We may close an account as described in Enforcement, or with 30 days’ notice for any other reason. If we close an account without cause, we refund the unused part of the current period.
- Sections that by their nature should continue after the account ends (for example your content licence to us for legal copies, payment obligations, disclaimers, liability limits and dispute terms) continue to apply.
16. Disclaimers
Except as these Terms expressly say, and to the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular business results, such as numbers of leads, bookings or sales.
17. Limitation of liability
To the extent the law allows:
- Neither of us is liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, leads, goodwill or data, even if warned they might happen.
- Our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the event that caused the claim.
These limits do not apply to liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence, and they do not limit your rights as a consumer where the law protects them.
18. Your responsibility for claims
You will defend and compensate us, and our staff, against claims, fines and costs (including reasonable legal fees) brought by third parties or authorities that arise from Your Content, your funnels, your use of Viewer Data or your breach of these Terms or the law. We will tell you promptly about any such claim and let you control the defence, and we will not settle it without your agreement where it would impose obligations on you.
19. Governing law and disputes
These Terms are governed by the laws of [country / state], and the courts of [city, country] have jurisdiction, unless the law of the country where you live as a consumer gives you the right to bring a claim in your local courts or under your local law.
Before starting any legal claim, please email support@videosayshi.com so we can try to solve it informally within 30 days.
20. General terms
- Changes to these Terms: we may update these Terms. For changes that reduce your rights or add obligations, we email account owners at least 30 days before they apply. If you keep using the Service after that date, the new Terms apply; if you do not agree, cancel before then. Changes needed for legal or security reasons may apply sooner.
- Notices: we send notices to the email address of the workspace owner. You can send notices to support@videosayshi.com.
- Transfer: you may not transfer your account without our written consent. We may transfer these Terms as part of a merger, acquisition or sale of assets, and will tell you if we do.
- Events outside our control: neither of us is responsible for delays caused by events beyond reasonable control, such as outages of internet or cloud providers, natural disasters or government action.
- Whole agreement: these Terms, the Privacy Policy, the Refund Policy and any order details form the whole agreement between us about the Service.
- If part is invalid: the rest still applies. Not enforcing a right straight away does not mean we give it up.
